TUCSON, Arizona (KVOA) — There has been yet another delay in the case of an Oro Valley woman accused of causing the death of two people in a crash back in 2019.
Jana Giron was convicted of tampering with evidence back in August and was set to be sentenced Monday, the hearing was supposed to start at 2 p.m. but didn’t begin until around 2:40 due to a closed-door meeting with prosecutors and the defense attorney.
When the judge took the bench he stated the defense was in the middle of making a pre-sentencing motion and to give them time to do that decided to issue a continuance.
It was the latest delay in a case riddled with twists and turns.
Giron was originally supposed to be sentenced in October but that date was pushed to November 25th.
Now the judge has scheduled sentencing for December 13th, giving the defense until Wednesday, December 4th to file the motion.
The nature behind the motion remains unclear.
Giron was facing several charges for the death of Caitlin Festerling and Paul Garcia following a car crash.
Prosecutors accused Giron of texting and driving and deleting the evidence.
A jury convicted her of tampering with evidence but was hung on the two manslaughter, two criminal damage, and a single charge of endangerment she was facing.
She is set to have a new trial in February 2025.
The victims’ families were present inside the courtroom and were asked by prosecutors if they had anything they wanted to say but declined.
