Moment Dani Alves walks free from prison weeks after being convicted of rape

Dani Alves has left prison for the first time in more than 14 months following his arrest for a nightclub rape. He was convicted of the rape four weeks ago.

He walked out of Brians 2 Prison near Barcelona just after 4pm local time with a warning he must sign on at court every Friday as part of his bail conditions or risk arrest as he appeals his four-and-a-half-year jail sentence. The three judges who determined his release also ordered aides to inform Brazilian consular officials of his travel ban in case he tries to get another Brazilian passport.

Police and other law enforcement agencies are expected to be given the details surrounding his travel ban to ensure Alves does not try to flee the country. Alves‘ attorney handed over both his Brazilian and Spanish passports in order to comply with the conditions of his release.

A restraining order barring him from coming within 1,000 metres of the victim is now also in place. Alves has been in jail since his arrest in January of last year and emerged in a grey jacket with a white turtleneck jumper underneath, getting straight into a car without speaking to media.

Spanish press have speculated Alves’ partner Joana Sanz will not share the house, which was built from scratch and boasts its own gym and pool, with her husband.

Sanz revealed last year she had demanded a divorce after Alves admitted for the first time to having sex with the woman he was found guilty of raping, but she claimed the relations were consensual.

The 31-year-old later said the divorce had been put on hold and she gave evidence on Alves’ behalf at his trial from February 5 to 7. Sanz has since deleted her Instagram profile in the aftermath of news breaking regarding Alves’ conditional release.

One of the three judges who determined Alves’ conditional release last Wednesday by simple majority admitted he was against the decision.

Luis Belesta claimed: “With regard to the flight risk, this court has considered that this risk existed on three occasions. The last of these was in our decision of 23 November 2023.

“Consequently, the circumstances that existed at the time of the previous rulings are not only maintained at the present time, but have been increased with the conviction and the possibility that this sentence may be increased on appeal, following the appeals lodged by the Public Prosecutor’s Office and the private prosecution.”
