Killer Jozef Puska used a previous conviction for having underage sex to stop him serving his life sentence in Mountjoy Prison, the Irish Mirror can reveal.
It is understood he got his lawyers to object to him being sent there because he is technically regarded as a sex offender. The 33-year-old brute was prosecuted in his native Slovakia when he was a minor for having underage sex with a girl.
The age of consent there is 15. He didn’t do jail time.

After Puska was sentenced over Ashling Murphy’s murder on Friday he was brought to Mountjoy on the orders of the judge. But after objections from his lawyers and a lot of internal discussions he was then moved back to Cloverhill where he had been held on remand for the last 20 months.
Puska argued he was a sex offender and therefore should only be held in one of the Irish prisons that house perverts – the Midlands Prison or Arbour Hill.
Both the Government and the Irish Prison Service have a mission statement that all inmates must be kept safe and secure. That is why sex offenders are kept together in specific jails and are never allowed to mix with the rest of the prison population.
A Mountjoy source said: “He did not want to serve his sentence in Mountjoy and was terrified of being detained there. Under no circumstances did he want to mix with the rest of the prison population in the Joy because he was afraid he would be killed.
“He used his previous conviction when he was a teenager to argue that he is a sex offender and then demanded to be housed in another prison where they are detained. We only have two prisons in the country that cater for sex offenders – the Midlands and Arbour Hill. It was then decided he would be sent to the Midlands Prison on Saturday but that hasn’t happened yet.
“The thing is he would have been in protected custody in Mountjoy for a long period of time and under no circumstances would he have been mixing with the other inmates.”
Another prison source said Puska was moved from Mountjoy to Cloverhill for operational reasons.
He said overcrowding was more a factor than the legal objections.
